摘　　要：当代世界刑罚的整体发展趋势是刑罚的轻缓化。刑罚作为对犯罪的反应,其不仅因文化而创立,更因文化的发展、变迁和进化而历经嬗变,刑罚轻缓化的直接动因是文化的演进。刑罚轻缓化的历史发展进程受到文化演进的制约和限制,文化的演进推动刑罚走向缓和;文化的演进推动刑罚关注灵魂、惩罚强度降低;文化的演进推动刑罚关注人权保障和重视人道主义。The development trend of Penalties is the penalty reprieve on the world today. Penalty as a reaction to crime, was created because of culture, and was evoluted because of cultural development and evolution, and the reprieve of penalty is the direct impetus to cultural progress. The historical process of the penalty reprieve is restricted by the development process of cultural evolution, and cultural evolution promotes penalty toward detente;promotes the evolution of cultural soul of concern penalty and decreases punishment intensity; promote the evolution of a culture of human rights safeguards and penalties attention tO the humanitarian.
