论单位经济犯罪的概念、构成要件及其刑事责任

摘　　要：单位经济犯罪是指刑法规定的单位为了谋取非法经济利益且在构成单位行为的情况下实施的严重破坏市场经济秩序、依法应受刑法处罚的行为。单位经济犯罪的构成要件,是刑法规定的、决定构成要件单位经济犯罪所必需的一切客观要件和主观要件的综合。在具备单位经济犯罪构成要件的情况下,单位经济犯罪即成立,单位经济犯罪刑事责任即产生。单位经济犯罪可产生双重刑事责任,单位经济犯罪刑事责任的承担方式主要实行双罚制,单位经济犯罪刑事责任的承担形式和内容具有独特性。Economic crime by unit refers to the conduct that is operated by the unit under the circumstances of constituting the unit act, undermines seriously the order of the market economy in order to gain illegal economic interests, and should be punished by the criminal penalty, which is prescribed by the Criminal Law. The constitutive requirements of the economic crime by unit are the integration of all the necessary objective and subjective elements prescribed by the Criminal Law to constitute the economic crime by unit. With the constitutive requirements, the economic crime by unit establishes and hence the criminal habilities. The economic crime by unit may bring double criminal habilities. The way of bearing the criminal liabilities is mainly double punishment system.
