摘　　要：文章介绍了无过错输血感染的构成要件及产生原因,针对无过错输血感染案件的司法现状及理论界主流观点的不合理之处,从血液的性质、风险控制、比较法、社会公正、血液安全决策及医学进步5个角度阐述了输血感染应适用《产品质量法》,由血液的提供者承担无过错责任。This article introduce the main reason of non-default tranfusion infection .In temps of the cases of non-default transfusion infection the Irrationality between the current judicial situation and main idea of theory were analyzed. From five aspects including blood nature, risk controlled, comparative law, social justice, safe decision of blood and social justice, We clarified that the blood transfusion infected cases shouid apply to the ‘Product Quality Law ＇ and the blood＇s providers should taken the responsibility of non-defauh transfusion infection.
