摘 要:针对中国《海商法》有关海运提单强制适用问题,分析国内理论和司法实务中引发的中国《海商法》是否对进出国内港口货物签发的海运提单具有强制适用,以及根据提单法律适用条款引用的外国法违反了中国《海商法》第44条的强制性规定是否给予确认的争论。论述中国《海商法》第4章虽为强制性规定,但并不能得出强制适用于所有进出口的海运提单。中国《海商法》只有作为提单的适用法时,才具有强制效力。提出中国《海商法》应明文规定其强制适用范围。This article focuses on the mandatory application on ocean bills of lading under China Maritime Code and analyses the debate on whether CMC is of mandatory application on ocean bills of lading in and out of China' s ports as well as that whether selection of foreign laws in accordance with applicable law provisions of the bill of lading is in violation of Article 44 of CMC. The paper is of the view that Chapter Four in CIVIC is of its mandatory application hut this does not lead to the confusion that it has mandatory effect on all ocean bills of lading in and out of China's ports. CMC has its mandatory effect only in such circumstance that it is chosen as the applicable law by the bills of lading. In order to solve the problem totally, this paper presents the views that CMC should provide for its mandatory application clearly.
