沉船沉物强制打捞清除的义务主体研究

摘　　要：运用物权法上排除妨害、预防妨害物权请求权的原理,从讨论排除妨害请求权的构成要件和相对人出发,对沉船沉物强制打捞清除的义务主体进行研究,认为沉船沉物强制打捞清除的义务主体为船舶所有人或船舶经营人,而不论其是否对造成沉船事故有过失。In light of the dispute on the subject of obligation for compulsory wreck removal, by use of theorem of a real claim for removal of interference in ownership, prevention against such interference, this paper makes a comprehensive study on the same based on the discussion on the constitutive requirements and counterparts for a real claim for removal of interference, and proposes that the ship owner or ship operator should be the subject of obligation for compulsory wreck removal regardless of the fault for wreck accident thereof.
