论我国公办高校的法律定位

摘　　要：根据我国现行法律,公办高校往往被划到事业单位法人的范围中去,因事业单位的概念具有不确定性,公办高校的法律地位也难以界定。文章主张借鉴大陆法系公务法人的概念,确立公办高校的公务法人的地位。According to the current laws, Colleges and universities established by the government are always put in the range of the institutional organizations. The institution corporations＇ concept being uncertain, it is difficult to fix the legal position of Colleges and universities established by the gevemment. After Tian Yong charging Beijing Science and Technology University, the theory about organizations authorized by law and regulation is accepted and applited widely in actual judicial practice, but its many fatal defects can not be concealed. The article inisits on drawing the concept of public corporation in the continent law genealogy, while ascertaining public corporation position of colleges and universities established by the government.
