浅析卫生行政执法中证据收集和应用

摘　　要：现阶段我国正着力于行政制度的改革,力求最大限度地实现公正、公平。单就卫生行政执法而言,则对证据提出了更高的要求。作者试从证据的角度对卫生行政执法中证据的收集和应用进行分析和归纳,并对证据的采用标准即客观性、关联性、合法性、非法证据的排除及证明力的判断等五方面进行了探讨,使卫生行政执法证据达到"事实清楚、证据确凿、程序合法"的证明标准,切实提高卫生行政执法质量。Currently,China is focusing on the reform of administrative system and much effort was put on achieving maximally justice and fair as well. Health administration and law enforcement have more strict requirements for evidence. The authors analyzed the avidence collection and their usage in health law enforcement from the aspect of avidence. Also the article discussed the standards for acceptable evidence, i. e. objectivity, relevance, and legitimacy, the exclusion of illegal evidence as well as the determination of the effectiveness of evidence. The purpose is to meet the standard of ＇ the fact is clear, the evidence is conclusive, and the procedure is legal＇and effectively improve the quality of health law enforcement.
