摘　　要：作为阐释犯罪与文化关系的一种分析视角和基础理论,文化冲突在犯罪学中具有重要的理论价值与研究意义。在我国,对犯罪之文化冲突理论的理解,长期以来停留在美国学者塞林所提出的文化冲突模式中。由于时代不同、国情有异,这种认识需要获得修正,犯罪的文化冲突理论亟待进行中国化。在中国社会转型和追求现代化的背景下,从文化规范性视角出发,主文化发生危机,犯罪亚文化大肆滋生,主文化与犯罪亚文化形成矛盾和对立。这种主文化与犯罪亚文化的冲突构成了我国犯罪之文化冲突论的深层本质。Cultural conflict in crime is of great theoretical value and research significance, as a perspective and fundamental theory to explain the relationship between crime and culture. In China, the understanding level of the theory of cultural conflict on crime has stayed in the cultural conflict mode proposed by Thorsten Sellin who is an USA scholar for a long time. As times change and conditions vary, this understanding requires amendments, and cultural conflict theory on crime needs to be suitable for China. In the event of pursuing China＇ s social transformation and modernization, main culture crisis rises while criminal sub -culture is breeding. Then main culture and criminal sub-culture become contradicted and antagonistic. In the perspective of cultural norms, the conflicts between main culture and criminal sub-culture constitute a deep nature of our cultural conflict theory on crime.
