关于工程招投标制度设计的思考

摘　　要：自从《招标投标法》实施以来，相关法规不断出台，规范工程招投标市场的力度不断加大。然而，虚假招标、串通投标、围标等不和谐音符屡屡出现，每年都会有不少人因串标被定串通投标罪。如，涉案金额近3亿元的全国最大市政工程串标案所有涉案人员分别被温州法院以串通投标罪判处刑罚，同时并处5万元至80万元的罚金。这些现象恐怕不能用“法制意识淡薄”一句话来概括，应从制度上予以考虑。Since the implementation of'Invatation and Submission of Bids Law',relevant laws and regulations were announced constantly,and constantly strength the power for regulating bidding market of project, however,some disharmony notes such as untruth bid,contacting bid,bid rigging etc occurs frequently, each year,there are some persons who were declared as conspirator bid crime.For example,all the persons involved in the biggest legal case of contacting bid project which involve near 300,000,000RMB were declared as contacting bid crime,and were charged for 50,000 to 800,000 RMB as penalty.These phenomenons can not be only concluded as'Legal Awarenessn,and should be considered from the rules.
