摘 要:我国农地产权的残缺以及征地制度对农地所有权的强行征收,直接破坏了以土地承包经营权为核心的农地产权制度,致使市场机制不能正常发挥配置土地资源的基础性作用。清晰且有保障的农地产权制度是运用价格机制配置土地资源的基础和关键。现阶段,应当明晰农村土地产权制度、培育和完善土地交易市场,建立有效的约束机制、规范政府征地行为,提高土地征用补偿标准、完善土地征用补偿机制。The incomplete farmland property rights and forceful requisition of farmland ownership have directly destroyed the farmland property rights system centering on contractual operation rights, making it impossible for the market mechanism to play a fundamental role in allocating land resources. Clearly defined and guaranteed farmland property rights system is the basis for and key to using price mechanism to allocate land resources. In the present stage, we should clarity rural land property rights system to cultivate and improve land market, establish an effective constraint mechanism to regulate land requisition by government, and raise compensation standard to improve land requisition compensation mechanism.
