构建我国现代自由心证保障体系的路径探讨

摘　　要：证据制度在诉讼法学中的基础地位是由诉讼自身的特点决定的,诉讼过程是运用证据查明案件事实的过程。现代自由心证制度是在批判地继承传统自由心证制度的前提下为世界各国所认同,在诉讼中它的价值表征是多方面的,因此应积极构建我国的现代自由心证制度。The fundamental position of evidence system in procedural jurisprudence is justified by the char-acteristics of litigation itself. The procedure of litigation is one that investigates into the facts and evidences and ascertains the reality. The modern evaluation of evidence system is internationally recognized under the precondition of critically inheriting the traditional inner conviction system. The characteristic value of the modern evaluation of evidence system in proceedings include many aspects.
