摘　　要：与主流司法文化相对应,存在一种司法亚文化,作为一种社会事实有其固有的特性和本身的功能,深刻影响着司法机关及司法工作人员的价值观念和行为模式。我国司法亚文化的生成基础既有司法行政化、错案追究等体制因素,又有面子与人情、实质正义等文化因素,还有职业压力、角色冲突等职业因素。The judicial sub-culture exists in correspondence with the mainstream of judicial culture.As a social reality,it has its own inherent characteristics and functions,affecting profoundly the values and behavioral patterns of judicial staff.China's judicial sub-culture is formed from such mechanical factors as administration of justice,accountability and punishment for wrong judgments,cultural factors such as relations and real justice as well as professional factors such as occupational pressure and role conflict.
