环境治理范式的演进与环境自觉行动

摘　　要：可持续发展思想的提出及其内涵的不断深化,促使环境治理原则和范式不断演进。传统的"命令—控制"型环境治理范式具有缺陷;而目前来看,新的环境治理范式"环境自觉行动",由于行为的实施依靠的是企业的自觉性,不受法律法规的约束而缺乏强制性,也有局限性。环境治理成就突出的加拿大,在推动和实施环境自觉行动中也面临着很多的问题和障碍。环境自觉行动并不意味着免除企业遵守环境法规的义务,而应是使企业基于现有政策和法律、法规,在环境治理创新方面有足够的灵活性和独创性,即希望企业的环境行为能够比法律规定的更好。The creation and continuous deepening of sustainable development thought makes the principle and paradigm of environmental governance continuous evolution, Traditional order- control style environmental governance paradigm has defects, however, currently, new environmental government paradigm, as environmental voluntary initiatives, also has its limitation because the implementation of the environmental governance depends on the voluntary behaviors of an enterprise and is not restricted by laws and is short of enforceability. The model country, Canada, which has made great progress in environmental governance, also has many problems and barriers in the process of the implementation of environmental voluntary initiatives. Environmental voluntary initiatives do not mean that the obligation of the enterprises to follow the environmental laws should be remitted, but that the enterprises should have agile and original methods based on current laws and regulations in environmental protection innovation, i, e. , the environmental behaviors of an enterprise are expected to be better than the requirement of the laws and regulations.
