摘　　要：以信托法的视角论证合作托管造林的法律关系,通过信托制度与委托代理制度的比较,阐述合作托管造林适用信托法的合理性及优越性,以及合作托管造林与民事信托兴起的关系。主张合作托管造林适用信托法,其目的在于受托人的债权人等不得强制执行信托财产。受托人违反信托挪用、侵吞信托财产除要承担信托法上的责任外,还要承担刑法上的责任。From the perspective of Trust Law, this article demonstrates the legal relationship of cooperating trustee forestation. Through the comparison between trust system and agency system, it expounds the rationality and advantage of application of Trust Law and relationship between cooperating trustee forestation with the rise of civil trust. In favor of the application of Trust Law on cooperation trustee forestation, this essay aims that the creditors of trustee are not able to enforce the execution of trust property. Any trustee who breaches of appropriation and peculation of trust property should take the responsibility not only according to Trust Law, but also Criminal Law.
