摘　　要：在监护人责任中,未成年行为人的过错对责任的承担有着很大的影响,所以在监护人责任中要考察未成年行为人的过错,并以"理性人"或"善良家父"的标准作为判定未成年行为人是否具有过错的标准,监护人责任的有无取决于未成年行为人是否具有过错。As far as guardians＇ responsibility is concerned,their minor child＇ s misdeeds have great influence on it.Therefore it is necessary to study the minor child＇s misdeeds in process of deciding the guardians＇responsibility,and take ＂rational man＂or＂kind parents＂as the standard for judging the minor child＇ s misdeeds. Guardians＇ responsibility depends on the minor child＇s misdeeds.
