摘  要:内容提要征地补偿安置争议裁决行为的性质既不是批准征用土地的人民政府一次新的具体行政行为,即通常意义上的行政裁决行为,也不是行政复议。解决这种既区别于一般的行政争议,又不同于普通的民事争议的带有许多行政性特点的特殊民事争议,其最佳的制度选择是构建专门的征地争议仲裁机制,即由批准征地的人民政府设立专门的中立性机构"征地争议仲裁委员会"统一解决因批准征地而引起的各种争议。这一争议解决机制是国家为当事人提供的一条便捷而专业的选择性救济途径,当事人如果选择了申请"征地仲裁委"进行裁决,就不能提起复议和诉讼。生效的裁决决定一经作出,即具有终局性法律效力。In nature, the arbitral behaviour towards the disputes of compensation and allocation in land confiscation is not a new specific behaviour of the people's government who issues the approval of the land confiscation, namely the normal administrative arbitral behaviour, nor the administrative check. To give solution to this special civil dispute which is distinguished from normal administrative dispute and is also different from the common civil dispute yet dotted with many administrative features, the best system option is to set up a special arbitral mechanism for land confiscation dispute, that is, the people's government who issues approval of land confiscation establishes a special neutral 'arbitral committee for land confiscation dispute' to solve the various disputes caused in the approval of land confiscation. This mechanism is a convenient and professional selective aide provided for the party by the state. If the party selects the application to the 'committee' for the arbitral, he could no more apply for check or litigation. Once the arbitral decision comes into effect, it has the function of terminal law.
