论国际贸易中行政指导行为的可诉性——以WTO的规则约束为视角

摘　　要：文章通过对行政指导相关概念的界定以及对中国现行行政指导规制制度的考察,在既有研究基础上得出结论:中国应以履行WTO的义务为契机,尽快革新行政法体制,将国际贸易中行政指导纳入到行政诉讼的受案范围中来,并在这一过程中积累经验,在时机成熟时将所有适格的行政指导纳入到行政诉讼的范围中来,建立完善的行政诉讼体制。On the basis of defining the relative concepts of administrative guidance and studying the currently employed administrative guidance regulations, as well as the research outcomes, the author comes to an conclusion： China has to take advantage of the opportunity of carrying out the obligations of WTO to quicken the reform of administration law system. Administrative guidance should be brought into lawsuits in international trade and we can get some experience in this process. And all suitable administrative guidance will be brought into lawsuits when the appropriate time comes so as to establish perfect lawsuits system.
