论我国农村集体土地物权主体的基础性--兼论我国农村集体土地物权研究的方法论取向

摘　　要：我国农村集体土地物权主体制度存在一些共识性的根本问题,这些问题已成为农村集体土地私权制度发展的前提性障碍。但最近的立法表明,农村集体土地物权主体问题被认为是一个难以解决的难题而被放弃;理论研究也形成淡化主体的趋势。然而我国农村集体土地物权主体制度历史演变揭示出的规律、法律构造的一般逻辑和我国农村集体土地物权主体社会基础的中国特性都表明,我国农村集体土地物权主体在整个农村集体土地私权构造中具有基础性地位,是理论研究和制度构建的逻辑起点。There are some essential problems that impede the development of China＇s farm collective land real right. The recent regulation shows that the issue concerning the subject of farm collective land real right has been abandoned because it is difficult to solve. At the same time, researches tend to ignore the subject of farm collective land real right. But the history of the real right system of farm collective land of China, the general logic of rule, the characteristic of social conditions suggest that the subject of property right serves as the base on which studies and regulations will be built.
