论奥林匹克知识产权保护的法律依据

摘　　要：奥林匹克知识产权是一种特殊的体育知识产权,它的实际所有者是国际奥委会,在举办奥运会期间及之后,举办者也可与国际奥委会分享一定的奥林匹克知识产权。奥林匹克知识产权的保护一方面是习惯的国际规则,获得各国的承认与尊重,并通过国内立法的方式加以确认;另一方面,国际奥委会通过与主办者签订合同的方式,利用各国国内的合同法律规范对奥林匹克知识产权加以保护。各国在保护奥林匹克知识产权方面积累了丰富经验,并形成了相关的保护规则。中国面临着2008年北京奥运会的发展契机,同样需要在奥林匹克知识产权保护方面做出自己的独特贡献。Olympic intellectual property-right is a special kind of sport intellectual property. Its owner is the International Olympic Committee. When one city hosting the Olympic Games, hosting city can share related Olympic intellectual property-right with IOC surrounding the Games. Legal foundation of protection of Olympic intellectual property-right contains two sides., on the one hand, according to international usage, countries accepted and respected the protection of Olympic intellectual property-right, and further confirmed the protection rules in domestic jurisdiction; on the other hand, depending on the means of hosting contract, IOC takes use of contract law of holder＇s domestic jurisdiction to protect Olympic intellectual propertyright. In practice, holders piled up rich experiences and developed a series of related rules. China obtained a valuable developing chance brought by Beijing Olympic Games, and should make corresponding, significant and unique contribution to protect Olympic intellectual propertyright.
