以现代法治为基:服务型政府构建的必然逻辑

摘　　要：现代公共行政日益突显政府的公共服务职能,服务型政府的构建掀起了新一轮政府改革的浪潮。在现代民主法治的语境下,服务型政府的构建必然要求以民主法治作为基础和保障,而且更加强调民主法治对政府行为的规范约束作用。因此,完善和健全行政立法体系,加强政府的行政执法力度,强化对政府行为的全方位监督,加快政府的问责制建设等将为服务型政府依法服务提供有效的制度保障。As modern public administration increasingly stresses government＇ s function on public service, a new surge of the reform occurs to build up a service-oriented government. In the context of modern democratic law and ruling, its construction necessarily demands for democratic law and ruling as the basis and guarantee and further emphasizes the function of regularization and restriction brought by democratic law and ruling to a government＇ s behavior. Thus, a service-oriented government will be perfect with such efficient guarantee as better system of administrative legislation, high quality of government＇ s rifling, overall supervision to government＇s behavior and fast construction of system of government inquiry.
