摘　　要：从全球范围来看,被害人的地位经历了一个由高到低再逐渐提高的辩证否定过程,而当前我国被害人的地位在保障犯罪人权利的呼声中被漠视了,亟待提高。恢复性司法程序是基于保障被害人权利而提出的新司法模式,对于我国被害人权利的保障具有重要的借鉴意义。In the world scope , the position of victim is being raising. Nowadays, the position of victim is ignored while the rights of crime are being strengthened in China. So it＇s time to raise the position of victim. Restorative justice is the new mode of justice, and supplies the new way to protect the rights of victim.
