农地征收中政府行为的合理性分析及规制

摘　　要：随着我国进入社会主义市场经济阶段,工业化与城镇化进程也日益加快,大量的农用地转化为城市用地与建设用地,造成了大量的失地农民生活陷入困境。究其原因,乃是立法滞后、政府行为不规范造成的。文章提出明确界定"公共利益"内涵、建立"征收"、"征购"双轨制及其相关程序的建议,以规范政府行为,切实保护失地农民的合法权益。When China entered the socialist market economy, the process of industrialization and urbanization also become fast; a lot of farm land was transferred to urban and construction usage, meanwhile, a lot of land-requisitioned farmers suffered hard life. The less-developed legislation and the nonstandard government action are the main reason, The suggestions of clear definition on “Public Benefit” and the procedure of “Expropriation” “Requisition by Purchase” are presented in order to protect farmers benefit.
