摘　　要：外交保护是国际法上一项传统的法律制度,它涉及一系列复杂的理论与实践问题。目前,联合国国际法委员会正在制定外交保护方面的条款草案。随着经济全球化的发展,中国也正实践着"走出去"的战略,研究外交保护法律制度对中国国际法学界的理论与实践有着重大意义。同时,外交保护法律制度与当代国际法领域的其他理论问题也相互促进,交互影响。Diplomatic Protection is a traditional legal system in international law, it involves a series of complicated theoretic and practical problems.
