摘　　要：警察权是行政权。这是因为:1.警察权在国家权力谱系中所处的位置决定其权力属性;2.侦查权具有完全的行政权属性而不具有司法权特征;3.司法机关所具有的行政权应予剥离。The police right is the administrative right. The reasons are as the following： First, the place the police right occupies in the state right pedigree decides its right property. Second, the investigative right has pedigree of through administrative right. It has no pedigree of judicial powers. Third, the administrative right, which belongs to the judicial organs, should be stripped.
