摘　　要：我国正处在加快建设法治国家,深化司法改革的新时期,清晰界定何为"司法"和"司法机关",意义重大。比较外国和联合国的法律文件,洞察中国国情,可以得出结论:"中国式"司法应为国家的诉讼职能活动,司法机关应为法院、检察院。这种解读既有理论根据,又符合我国政治体制。China is speeding up its construction of rule of law society and deepening its judicial reform. Accurate definitions of justice and judicial organization have great significance in such a new period. Through comparison with foreign and United Nations legal documents and contemplation of China current situation, the authors make following conclusion ; Chinese - style justice should serve for the state prosecution function performances and the organizations with judicial power should only be courts and procuratorates. Such an interpretation not only has its theoretical roots but also makes accordance with China＇s political system.
