摘 要:角色商品化权是一种与著作权、商标权截然不同的权利,它是一种商品化权。要清晰地认识角色商品化权,首先必须对角色明确界定。角色必须具备实质的人格化特征、良好的公众效应和商业化运用的能力才能获得法律的保护。由于各国对角色商品化权性质的认识不同,各国对角色商品化权的保护方法也不尽一致,主要有著作权法保护、商标法保护、反不正当竞争法保护及公开权保护,但究竟如何才能更好地对角色商品化权进行保护仍有待探究。Right of part commercialization is one kind of right that is different from copyright and trade mark right. In order to understand the right of part commercialization clearly, we should clearly define the part role firstly. The part role must have three conditions to obtain the law protection, which are essential personality character, good public effect and ability of commercialization exertion. Owing to the different cognition to the habitude of right of part commercialization, the means of law protection are diversified. There are mainly four methods which are Law of Copyright, Law of Trade Mark, Law of the People's Republic of China Against Competition by Inappropriate Means and Public Right. But we should continue to study how to protect right of part commercialization all the better.
