摘　　要：针对我国目前对学生伤害引发精神损害处理没有明确的法律规定,致使实践中该类精神损害得不到充分合理赔偿的问题,提出了建立学生伤害引发精神损害处理机制,分析了其概念、特征和功能,并确定了权利主体、客体和赔偿数额,力求使该构想具体化。There are no definite provisions on the spiritual damages which caused by students in our country so that victims couldn＇t receive ample and reasonable compensation. To settle this problem ,this paper sets up the disposal system of spiritual damages which is caused by students, analyzes it＇s definition, character and functions, and conforms the subjects and objects of the rights, and the amount of compensation to make it more concrete.
