摘　　要：在横向范围上海域包括历史性水域,在纵向范围上海域包括海上空间。海域空间应该进行区分利用。滩涂为海域的组成部分,《宪法》以及《民法通则》、《土地管理法》等法律中的有关滩涂属于土地的规定应该进行修订。In crosswise scope, sea area includes historical waters. In vertical scope, sea area includes airspace above the sea. The sea area space should be used differently. Mudflat is the constituent of the sea area. The articles that mudflat belongs to the land in Constitution , General Provisions of the Civil Law and Land Administration Law should be revised.
