摘　　要：从我国目前保护商业秘密的立法现状看,我国现有商业秘密立法存在诸多问题,应从制定专门商业秘密法、增加处罚性赔偿金制度、采取举证责任倒置、对正当竞争行为侵犯商业秘密应予约束等四方面完善我国商业秘密立法。On the basis of the current legislation situation of protecting business confidenticalities in China, this paper analyses the existing problems in business confidentinality legislation and puts forward four suggestions on perfecting the legislation： establishing specific business confidentinality law strengthening the penalty compensation system by increasing the sum of penalty compensation, inversing the burden of testimony, restricting the right competitive behavior which could infringe business.
