摘　　要：基督教对西方法律的影响主要表现为精神上的启蒙和推动多元社会机制形成两个方面。对西方法律传统的形成起着决定作用的自然法是以基督教神学和亚里士多德的哲学为基础的,也是以基督教会与世俗权力做斗争的历史中所形成的多元政治为基础的。理解和研究基督教法学中的智慧,追求神学的超验正义、普世博爱和超越人性弱点的精神境界,建立来自心灵深处的法律感情与社会公德,并将之与我们民族的传统文化道德的精华相结合,铺设好支撑现代法治文明大厦的社会—文化基础,构建一个具有东方特色的、多元的和谐的社会,应该成为我们所追求的"中国法律理想图景"中的一个部分。The influence of Christianity to the Western law is shared by the spiritual enlightenment and the function of multisociety. Natural law which decided the formation of Western legal tradition is based on Christian theology and the philosophy of Aristotle, and also based on the multi-polity established by the struggle between church and common power. To learn and research the wisdom and value in Christian law, to pursue a spirit compass of theological transcendent justice, general love and above human being＇s weakness, to build a legal feeling and social morality, and combine all of these with the elites of our national traditional cultural and morality, in order to pave a social-cultrual foundation for supporting a high-rise of modern rule of law and a multiple, harmonious society with oriental characteristics should be a part of the ideal prospect of Chinese lawwhich we are going in for.
