摘　　要：破产法律责任是指因造成企业破产或违反破产法的规定所应承担的法律责任。破产法律责任具有惩罚破产违法和破产犯罪行为,救济破产法律关系主体受到的损失,恢复受侵犯的权利,教育破产违法者和其他社会成员,预防破产违法犯罪的功能。破产法律责任包括债务人因破产而产生的法律责任和破产欺诈行为产生的法律责任两种类型。作为债务人的企业从事了隐匿资产、逃避债务等欺诈行为,其法定代表人或直接责任人应当向债权人承担民事赔偿责任。债权人也有权在法定期间内,通过破产管理人请求法院宣告其侵害债权人利益的民事行为无效。债务人企业的法定代表人或直接责任人对导致破产有故意、重大过失甚至构成犯罪的,应当承担相应的民事、行政、甚至刑事责任。Go bankrupt legal liability, is to refer to legal liability should bear it by the regulation because of bringing about business failures or violating a bankruptcy law. Go bankrupt legal liability has punishment going bankrupt breaking the law and going bankrupt criminal act, relieve go bankrupt the loss that the legal relation main body suffers, restores the right being infringed upon , education goes bankrupt person who breaks the law and the function that the member of society, prevents from going bankrupt breaking law and committing a crime other. Go bankrupt the legal liability legal liability including that the debtor comes into being because of going bankrupt composes in reply the type cheating two kinds legal liability that behavior produces going bankrupt. As debtor＇s enterprise fraudulent conduct , the person legal representatives or direct responsibility such as having been engaged in hidden assets , having dodged a creditor, person ought to bear civil compensation responsibility to the creditor. The creditor also has right civil behavior requesting that the court declares that the person encroaches on creditor benefit by the trustee in bankruptcy in legal period inner to invalidate. Person leads to debtor enterprise legal representative or direct responsibility face to face go bankrupt having the deliberately , significant fault to compose corresponding civil , administration , even criminal responsibility committing a crime , ought to bear it even.
