摘　　要：比较NBA与CBA可以看出,NBA与CBA产生的背景不同,两者的职能也不相同.NBA联赛市场产生了俱乐部业主与NBA总裁?俱乐部业主与俱乐部总经理两个层次的委托代理机制,而CBA组织机构与投资者之间的委托代理关系不清晰,投资者与职业俱乐部经理人之间尽管存在着形式上的委托代理关系,但二者缺乏通过制度、契约所建立的运行通畅的激励与约束机制.不过,CBA联赛组织机构与体育中介机构之间建立起的委托代理机制,在设计上具有一定的创新价值和积极意义.NBA与CBA在外部政策和内部制度上有很大差异,NBA有"垄断豁免权"等很多外部优惠政策,CBA尚无任何外部优惠政策;NBA有完整的系统内部法规体系,CBA的内部法规体系尚不系统和完整.From the comparison between NBA and CBA,it can be found that NBA and CBA have different backgrounds and functions.NBA basketball league tournament market has produced club owner and presidents,the club owner and club general manager,these two levels commission and agent mechanism.The commission and agent mechanism between our country CBA organizations and investors are not clear.Although investors and professional club managers have existed formal commission and agent relations,they are lack of the encouragement and the restraint mechanism by the system and the contract.But then,the commission and agent mechanism between our country CBA league tournament organizations and the sports agency organizations have a certain innovation value and the positive significance in the design.NBA and CBA also have great differences in the management： NBA has many exterior preferential policies,such as ＂the monopoly exemption power＂,while CBA still does not have any exterior preferential policy;NBA has the complete interior laws and regulations system while the CBA internal laws and regulations system still not systematic and integrated.
