摘 要:为使土地承包经营权流转达到符合"条件、自愿、规范、有序、依法"之客观要求,真正维护土地承包经营权流转双方的合法权益,对土地承包经营权流转进行分类尤为重要且具有理论价值和极强的实践意义。土地承包经营权流转除土地承包经营权流转方式分类外,按不同标准可有11种分类,其中,按土地承包经营权流转方式、农村土地承包方式和流出方其物权是否丧失或是否保有这三种分类最具有理论价值和实践意义。In order to realize the circulation of the right to land contractual management according to law, on a conditional and voluntary basis and with standards and order, as well as to really protect legal rights of both parties in the circulation, it is very important to classify the circulation of the right to land contractual management, which is valuable in theory and significant in practice. Besides the classification by the circulation form, there are 11 kinds of classification of the circulation of the right to land contractual management according to different criteria. Among them three kinds am of great value to both theory and practice. They am classification by the circulation form, contracting form, and the criterion whether the assigning party should lose or retain the real right.
