民族自治地方政府与其他地方政府行政权力的比较研究

摘　　要：民族区域自治制度下的民族自治地方政府设置模式,是一种独特的中央与地方的行政权力划分方式,适应了解决中国民族问题的需要。将民族自治地方各级政府与我国其他地方各级政府的行政权力相比较,特别是将五大自治区政府与其行政层级相近或者相似的"较大的市"政府、经济特区政府、特别行政区政府的行政权力相比较,有利于进一步揭示民族自治地方政府行政权力的内涵和实质。民族自治地方政府除了可以享有宪法和法律赋予一般地方政府的行政权力外,还与民族自治地方的人民代表大会共同作为自治机关行使自治权。这使得民族自治地方政府的行政权力不仅不同于一般的地方政府,而且不同于"较大的市"政府、经济特区政府、特别行政区政府这些原本也是特殊的行政权力配置。The mode of the people's governments of the ethnic autonomous areas under the system of regional ethnic autonomy is a special way to delimit the administrative power between the center and local People's governments.The mode meets the need for resolving ethnic problems of China.The compare of the administrative powers between the ethnic autonomous and the other local governments at all levels,especially between the people's governments of the five ethnic autonomous regions and local governments which are close in level to the five regions,like 'comparatively larger cities,' special economic zones and special administrative regions,helps to reveal the substance and spirit of the administrative powers of the people's governments of the ethnic autonomous areas.Besides of the administrative powers by the Constitution and the laws just like other local governments,the people's governments together with Congress of the ethnic autonomous areas,as the organs of autonomy,have the power of autonomy.So the administrative power of the governments in the ethnic autonomous areas is different from the common local governments,and different from some special local administrative power of 'comparatively larger cities,' special economic zones and special administrative regions.
