转化抢劫罪成立要件新解

摘　　要：转化抢劫罪是抢劫罪的一种特殊类型。在立法技术方面,转化抢劫罪属于法律拟制,二者在罪质方面具有同一性。因此,成立转化抢劫罪必须具备:一是实施盗窃、诈骗、抢夺行为;二是当场实施暴力或以暴力相威胁的行为;三是主观目的是为了窝藏赃物、抗拒抓捕或者毁灭罪证。"当场"是指盗窃、诈骗、抢夺行为现场以及其行为"延长线"所涵盖的场所。Crime of transformed robbery is a special type of robbery. On the technology of legislation, crime of transformed robbery is legal fiction because they are the same on criminal substance. So, the component conditions for the crime of transformed robbery includes committing the crime of theft, fraud or forcible seizure of money or property and using vioIence on the spot or threatening to use violence in order to conceal the booty, resist arrest or destroy the criminal evidence. The spot is the scene and the prolong of scene.
