美国“情报自由法”浅析——兼与中国《政府信息公开条例》比较

摘　　要：政府信息公开与否是判断政府民主、法治发展水平的一个重要标志。情报自由法在美国行政公开中占有非常重要的地位。我国2008年5月1日即将实施的《中华人民共和国政府信息公开条例》与之相比较,二者产生的背景、公开的方法、公开的内容相似;但是二者的法律位阶、救济手段不同。Whether the government publicizes the information is an important standard of democracy and rule by law. Freedom of Information Act plays an outstanding role in U.S. administration, compared with which the Government Information Public Regulation of the People＇s Republic of China which will be put in force on May Ist, 2008 has the same background, method and content. But the two are different in legal position and approach of relief.
