村民选举权利的法律保障与救济

摘　　要：村民选举权是法律赋予村民的一项基本民主权利。随着社会主义市场经济的不断深入及农村利益关系的日趋复杂,村民选举权利在一些地方受到了不同程度的侵害,这不仅挫伤了村民政治参与的积极性,而且也破坏了村民自治组织的合法性,进而影响到农村社会的稳定。应采取各种切实有效的措施,建构相应的权利保障和救济机制,从而从制度安排上保障村民选举权利不受侵害。The villager＇ s voting right is a basic democratic right given by the law. With the constant deepening of socialist market economy and more complicated rural interests relations, the villager＇ s voting right has received violations in various degrees in some places. This not only will dampen the enthusiasm of villager＇ s political participation but also will destroy the legitimacy of villager＇s autonomy organization, and then influence the stability of the rural society. For this reason, we should take various effective measures and build the corresponding right safeguard and remedy mechanisms to ensure the villager＇ s voting right not to be violated on arranging from the system.
