摘　　要：作为电子数据的手机短信已经以一种新的证据形式进入诉讼程序。在司法实践中,涉及手机短信作为证据的案件不断出现。如何看待手机短信的证据资格及如何认定手机短信的证据效力,是证据理论和实务上亟待解决的问题。As electronic data, short message service has already entered the judicial proceedings as a new kind of evidence. In judicial practice, the cases emerge unceasingly in which short messages appear as evidence. How to treat the competence of evidence for short message service and how to determine the validity of short message for testifying are urgent to solve in evidence theory and practice.
