摘　　要：就国际法效力根据的问题,长久以来各学派众说纷纭。然而,现有的诸多观点都是在既有的法理学基础之上以国内法理学的观点来套用国际法,因而未能诠释问题的本质。国际法之所以为国际法,其效力根据在法律层面上源于国家的意志协调,在社会层面上源于国家在国际社会中交往的必要。For a long time there has been much controversy on the basis of validity of International Law. However, all kinds of analysis are based on national jurisprudence, which can＇t illustrate the nature of the problem. Actually,. the basis of validity of international law is the coordination of national volition on the level of law and the necessity of international communication on the level of society.
