摘　　要：奥利弗·温德尔·霍姆斯的法律思想确立了美国最高法院20世纪法哲学的航程。他的思想本身并未建立起一个完整的理论体系,有些观点甚至自相矛盾。他既是法律领域的革命者,又是法律理论上的机械论者;既是法律领域的实用主义者,又是法律领域的自由主义者。Oliver Wendell Holmes was deemed to define the future direction of legal philosophy in Supreme Court in 20th century. Integrated theoretical system has not been built of his thinking, indeed self-. He is not only a revolutionary in law circle, but also a mechanist in law theory; he is not only a pragmatist but also a liberalist in law circle.
