国家助学贷款制度中高校责任研究  

On the Responsibility of University in the State-subsidized Student Loans

摘　　要：国家助学贷款现行制度中,高校对法定义务和约定义务的违反成为其承担责任的依据。该责任可以归结为三方面:承担部分风险补偿金的责任,承担贷款额度的减少的责任,承担行政责任。这些责任与高校在国家助学贷款中所担任的角色——"介绍人"不相符合。在国家助学贷款中,高校应当只承担与其过错相适应的责任,适用过错责任原则对其归责,且在其受益范围内以经济补偿为主要责任形式。In accordance with the current system of State-subsidized Student Loans （SSL） ,the responsibility of university could be concluded into three kinds, partial compensation of loan risk, the decrease of loan,and adminstration responsibility. These responsibilities dofft accord with the role of ＂introducer＂ played by universities in SSL. The paper therefore puts forward that it is reasonable for universities to take the responsibilities suiting for the fault of universities. Liability for fault principle would be the key of the university responsibility system, and the main form of the university＇s responsibility is economic compensation.
