企业海外发展的法律保护与法律适用问题

摘　　要：企业"走出去"必然引发海外权益的法律保护问题以及随之而来的法律适用问题。本文从国际私法角度,分别就我国企业海外发展的机遇与风险、权益法律保护涉及的国内与国际法律制度、争议解决的非诉讼方式和国际民商事诉讼程序等方面进行了分析论述。When businesses go to develop overseas, they are surely to be faced with whether their rights and interests can be fully protected overseas and with the subsequent question of legal application as well. From the perspective of the private international law, this article makes an analysis of opportunities for Chinese businesses to develop overseas and relevant risks, domestic and international legal systems concerning legal protection of the rights and interests, non-litigation for dispute settlement and procedures for international civil and commercial disputes.
