论我国创业投资保险法的构建

摘　　要：高科技创业投资蕴含着许多风险,而发展我国创业投资保险事业,可以有效地化解创业投资风险,鼓励创业投资。基于我国尚未进行创业投资保险立法、无法分散创业投资风险的现状,分析指出我国应制定《创业投资保险法》,明确创业投资保险的政府保证性质,设立专门的创业投资保险机构承办创业投资保险业务,由国家科技部作为主要审批部门;创业投资保险机构的资金由政府财政拨款和投保人保费共同构成,创业投资保险的范围仅限于高科技创业投资项目。Tbe venture capital insurance system can effectively solve risks in the course of high technology venture capital and can push forward the further development of high technology venture capital. Venture capital insurance legislation should be established in China. The character of venture capital insurance system is governmental guarantee. A special organization should be set up to undertake risks of the venture capital and the ministry of science and technology should examine and approve the affairs of insurance. The fund of organization of venture capital insurance is made up of financial assistance given by government and insurance premium.
