我国成年人监护之检讨与完善——以《英国意思能力法》为视角

摘　　要：从我国目前成年人监护制度所面临的问题出发,指出目前我国成年人监护存在的社会背景和目前我国法律规定及相关的问题,得出了改革的必要性。然后从借鉴的角度出发介绍了英国的《意思能力法》制定的背景和关于持续性代理权的内容,从而提出几点改革的建议。This paper, in view of the problems our country faces in the guardianship of adult, tries to bring into the focus on the problems existed in the social background and China＇s current legal provisions and related issues. Based on it, the writer comes to the conclusion of the necessity of the reform. And then, by way of introducing the background of Mental Capacity Act of England and the content of the lasting power of attorney, the writer puts up some suggestions for the reform.
