摘　　要：自加入世贸组织后,我国法律面临着与相应制度全面接轨的问题。即发侵权是应TRIPS协议规定增设的一项制度,它对我国"无损害即无责任"的传统侵权制度提出了极大挑战。应在探讨其构成要件与立法功能的基础上完善这一制度,使其符合TRPIS协议的要求。Chinese law is facing a problem corresponding to international rules since China having entered WTO.Imminent infringement has been added in accordance with TRIPS.It has brought an extremely large challenge to Chinese tradition capital verification that there is not responsibility without damage.To improve the system,it ought to study its constructive factors and legislative function with the TRIPS.
