以人为本纬度下社会弱势群体权利保护的价值取向研究

摘　　要：建构社会弱势群体权利保护制度必须理清弱势群体权利保护的价值取向,以人为本为社会弱势群体权利保护的价值选择提供了一个全新的视角。以人为本是社会弱势群体权利保护的核心价值,以人为本要求在权利与权力、权利与义务上更加重视社会弱势群体的权利,在效率与公平上在现阶段应更加注重公平原则,在形式平等与实质平等上坚持正义原则。To build a system to protect the social vulnerable groups＇ rights, we should understand the value orientation of protecting the social vulnerable groups＇ rights. The view of human-oriented provides us a new angle for the value choice of protecting the social vulnerable groups＇ rights. As the essential view of scientific development, human-oriented is of the core value for the rights protection of vulnerable groups. The social vulnerable groups＇ rights should be paid more attention to over the rights and power, the rights and duty; the fairness should be paid more attention to over the efficiency and fairness; the justice should be insisted in over the formal equality and substantive equality.
