摘  要:船货双方的利益之争随着国际货物运输的产生而产生,影响着并反映在有关的国际海事公约中。从目前已经生效的相关国际公约中可以看出,船方在这场利益纷争中一直占据着优势,但是货方的力量也在不断增强。随着运输法公约草案的起草、制订以及货方力量的不断增强,可以预见船货利益之争将出现新的格局。通过对有关国际公约变革轨迹的叙述,对船货双方利益之争进行详细分析,希望能对将来完善中国《海商法》有所裨益。The interest conflicts between the ship owner and the cargo owner have started from the beginning of the international transportation. And this conflict reacted in the relevant mari- time conventions, which are effective concurrently now. The ship owner always held the predominance in the past time. Meanwhile the power of cargo owner was intensifying. With the drafting of the new transportation convention and the gradual strengthening of the power of cargo owner, it appears that a new system of interest between ship owner and cargo owner may be established. The paper focused on the analysis of the tracks of history of the international maritime conventions. Hopefully, it would be helpful for the Chinese legislation in the future with amending of Chinese Maritime Code.
