论现代民主与司法独立之关系

摘　　要：现代民主和司法独立二者之间在理论上究竟是一种什么样的关系,学界一直未有充分论述。应当说司法和民主并没有多少直接的联系,但是司法独立只有在现代民主政体下才可能存在,反过来,现代民主有着其固有缺陷,而独立的司法对于弥补其缺陷有着独特的功能。Nowadays there isnt any full illustration on relationship between modem democracy and independence of jurisdiction in theory. In fact, they have no direct relations with each other. However, judicial independence can be realized only under the circumstance with modem democratic system and can make good the natural defects existing in modem democracy.
