摘　　要：以科学发展观为指导,加强和完善环境保护立法,是贯彻落实党的十七大精神的一项具体任务。环境问题的特殊性决定了环境保护中公众参与的必要性,因此,在环境立法上确认公众参与权,完善环境保护公众参与制度是当务之急。By strengthened and perfected legal system construction under the scientific devement outlook, it is one of the detailed aims in implementation of the spirit of 17th Party Congress. In addition, The necessity of the public participation is decided by the environmental peculiarities in environmental protection. From the point of view of the structure the national environment legislation, it is necessary to affirm the right of environmental participating of the public and improve the system of the public participation in environmental protection.
