农民工问题的法社会学分析

摘　　要：本文通过对农民工阶层法律地位及其权益状况的分析,从法理角度指出:农民工一方面作为我国公民拥有法律规定的平等权,另一方面却又得不到有力的法律保护而处于边缘化的法律地位;我国农民工权利受阻的最大障碍主要是立法不平等和适用不严格以及权利调节救济机制设置不合理。农民工所享有的个别劳动权是其维护个人利益的权利基础,集体劳动权是维护其社会利益的权利基础。农民工可以通过私力救济、公力救济、社会救济来保护自己的权利。This paper analyses peasant worker phenomenon through the legal status and the condition of rights of the peasant worker class on the view of jurisprudence. It points out two problems： one is that peasant workers posses equal right, the other is that they who can not be defended adequately are in marginalization of legal status, the paper proposes that the most important obstacle in hindering migrant workers＇ right are unequal legislation, not rigorous application and irrational mechanism of right regulating and relief. The individual labor right which peasant workers enjoy is the base of safeguarding individual interests. Collective rights to work is the base of protecting public interests of society. Peasant workers can protect their own rights by means of civil enforcement, public remedy, social relief and so on.
